1. Acceptance of Terms

Welcome to Promoofferhub ("we", "our", "us"). These Terms & Conditions ("Terms") govern your access to and use of our website, mobile application, and all services provided by Promoofferhub, including meal delivery subscriptions and corporate catering. By visiting our website or placing an order, you agree to be bound by these Terms and all applicable laws and regulations.

If you do not agree with any part of these Terms, you must refrain from using our services. These Terms apply to all users of the site, including browsers, vendors, customers, and contributors.

2. Orders and Subscriptions

When you place an order or subscribe to a meal plan, you make an offer to purchase our products. We reserve the right to accept or decline any order for any reason, including product availability, errors in pricing, or suspected fraudulent activity. Once an order is confirmed, a contract is formed between you and Promoofferhub under these Terms.

Subscription plans are billed on a recurring basis (weekly, bi-weekly, or monthly as selected). You may pause, modify, or cancel your subscription at any time through your online account or by contacting our customer support team. Cancellation requests received after a billing cycle has been processed will take effect from the next billing cycle.

We reserve the right to update or amend the menu, pricing, or subscription terms at any time with reasonable notice. Any changes will not affect orders already confirmed.

3. Pricing and Payment

All prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated. Delivery fees are calculated based on your location and order value. We accept all major credit cards, debit cards, and select digital payment methods. All payments are processed through secure, PCI-DSS compliant payment gateways.

You agree to provide accurate and current payment information. If your payment method is declined, we will attempt to notify you and may suspend your subscription until payment is successfully processed. We reserve the right to refuse or cancel orders if there is a material pricing error.

4. Delivery and Freshness

We make every effort to deliver meals within the requested delivery window. However, delivery times are estimates and may vary due to traffic, weather, or unforeseen circumstances. We are not liable for delays caused by events outside our reasonable control.

All meals are prepared fresh on the day of delivery and held at safe temperatures until they reach you. Upon delivery, you are responsible for promptly refrigerating or consuming your meals. We recommend consuming fresh meals within 3 days and frozen meals within 30 days for optimal quality. Please refer to the individual product labels for specific storage instructions.

5. Refund and Cancellation Policy

Our refund policy is set out in detail in our Refund Policy page, which is incorporated by reference into these Terms. In summary, if you are not satisfied with the quality of your meal or your delivery experience, you may request a refund or credit within 48 hours of delivery.

We do not offer refunds for subscription fees already paid if the subscription has been partially used or if the request is made after the billing cycle has begun. However, we may, at our sole discretion, issue a credit or partial refund in exceptional circumstances. Any promotional or discounted items are non-refundable unless defective or incorrect.

6. Limitation of Liability

To the maximum extent permitted by law, Promoofferhub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of our services. Our total aggregate liability for any claim relating to the provision of services shall not exceed the amount you have paid to us for the specific order in question.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of consequential damages, so the above limitations may not apply to you. We do not exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

7. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland. You agree that you are solely responsible for compliance with all local laws regarding the use of our services.
